For road transport of goods, for the vehicle rental with or without driver, for the Committee on transport as well as for activities of freight forwarder, shipping agent and air cargo, to broker freight and customs agent, agreed payment periods cannot exceed thirty days from the date of issue of the invoice.
The terms of settlement must specify the conditions for the application and the interest rate of the delay penalties payable the day following the date of settlement on the invoice as well as the amount of the fixed allowance for collection costs where the amounts due are settled after that date due to the creditor. Unless otherwise provided, which cannot, however, fix a rate lower than three times the legal interest rate, this rate is equal to the interest rate applied by the European Central Bank to its refinancing operation of the latest increased by 10 percentage points. In this case, the rate applicable during the first half of the year in question is the rate in force on 1 January of the year in question. For the second half of the year in question, it is the rate in effect on July 1st of the year in question. Late fees are payable without the need a reminder. Any professional situation of late payment is debtor, against the creditor, flat-rate compensation for recovery costs, which amount is fixed by Decree. When the recovery costs incurred are higher than the amount of the lump sum, the creditor may demand further compensation, on justification.
Are subject to administrative fines which the amount cannot exceed €75,000 for a physical person and €375 000 for a legal person not meeting payment deadlines mentioned in the eighth, ninth and eleventh paragraphs of the article I. The fine is imposed under the conditions provided for in article L. 465 - 2. The amount of the fine imposed is doubled in the event of repetition of the breach within a period of two years from the date on which the first decision of sanction became final.
